1. About IPAFOperatorUK Ltd

IPAFOperatorUK Ltd, trading as IPAF Operator UK ("we", "us", or "our"), operates a specialist temporary operator supply service for businesses requiring certified powered access equipment operators.

We supply IPAF-certified operators to construction, industrial, facilities management, infrastructure, renewable energy, and related clients on a temporary assignment basis.

We operate as a temporary employment agency / labour supplier. We engage qualified self-employed subcontractors, verify their credentials where appropriate, and deploy them to client sites to operate mobile elevated work platforms, including cherry pickers, scissor lifts, boom lifts, and other MEWPs.

We contract with clients as the principal supplier of temporary labour.

2. Our Role

Our role includes:

  • Receiving booking requests from clients
  • Reviewing job requirements
  • Matching suitable operators to assignments
  • Checking relevant operator details, certifications, and availability
  • Confirming assignment details with clients and operators
  • Managing scheduling, communication, and deployment
  • Processing platform payments, invoices, or agreed payment terms
  • Maintaining assignment records

Operators supplied through our service are generally self-employed subcontractors unless otherwise agreed in writing.

We are not the owner, operator, hirer, or maintainer of the powered access equipment used on site.

We do not control the client's site, working environment, risk assessments, method statements, equipment condition, or day-to-day site supervision.

3. Operator Status

Operators using our platform or accepting assignments through us confirm that:

  • They are self-employed unless otherwise agreed in writing
  • They are responsible for their own tax, National Insurance, and statutory obligations
  • They hold valid IPAF certification for the categories they advertise or accept work for
  • They will keep certification, availability, contact details, and experience information accurate and up to date
  • They are legally entitled to work in the United Kingdom
  • They will only accept assignments they are competent, qualified, and legally permitted to perform
  • They will follow all site rules, health and safety requirements, risk assessments, method statements, and lawful instructions given by the client or site management
  • They will behave professionally and not bring IPAF Operator UK into disrepute

Operators may be required to provide evidence of certification, insurance, right-to-work status, or other compliance information before being offered or confirmed for assignments.

4. Client Responsibilities

Clients using our service agree that they are responsible for:

  • Providing accurate job, site, access, equipment, and safety information
  • Confirming the required IPAF category or MEWP type
  • Ensuring the site is safe and legally compliant
  • Ensuring the equipment is suitable, inspected, maintained, and safe to use
  • Providing site induction, supervision, risk assessments, method statements, and emergency procedures
  • Complying with all applicable health and safety laws and regulations
  • Ensuring the operator has safe access to the work area
  • Confirming any special requirements before the assignment starts
  • Paying all agreed fees, charges, invoices, or booking amounts on time

The client remains responsible for site control, site safety, equipment condition, and the working environment.

5. Bookings and Assignments

A booking or assignment is not confirmed until we have accepted the booking request and confirmed the operator, date, location, and assignment details.

We may decline, cancel, or amend a booking where:

  • No suitable operator is available
  • The job information is incomplete or inaccurate
  • The required certification category is unclear
  • The site or work appears unsafe or unlawful
  • Payment, deposit, prepayment, or invoice approval has not been arranged
  • The client or operator has breached these terms

We will make reasonable efforts to supply a suitable operator, but we do not guarantee availability for every request.

6. Payments, Invoices, and Fees

Fees may be charged for bookings, temporary operator supply, platform services, job postings, administrative services, or other agreed services. All applicable fees will be displayed, quoted, or agreed before confirmation where possible.

Depending on the booking type, clients may be required to:

  • Pay in advance
  • Pay a deposit
  • Pay through Stripe or another payment provider
  • Provide a purchase order number
  • Pay by invoice under agreed payment terms
  • Pay within 7, 14, 30, or another agreed number of days

Where invoice terms are granted, the client agrees to pay invoices by the due date. Late payments may result in suspension of services, cancellation of future bookings, recovery action, or additional charges where legally permitted.

Operators are not authorised to vary client payment terms unless agreed by IPAF Operator UK in writing.

7. Cancellations and Non-Attendance

Cancellation terms may vary depending on the assignment, notice period, and booking type.

Where a client cancels a confirmed booking at short notice, a cancellation charge may apply. This may be used in whole or in part to compensate the assigned operator for lost time, travel, or availability.

Where an operator cancels, fails to attend, or is unable to complete an assignment, we will make reasonable efforts to find a replacement operator where possible.

We are not liable for losses caused by operator illness, travel disruption, emergencies, site refusal, equipment failure, weather, client error, force majeure, or circumstances outside our reasonable control.

8. Certification and Compliance

We may check operator certifications and credentials, but clients should also satisfy themselves that the supplied operator is suitable for the specific site, equipment, and task.

An operator's IPAF certification confirms training for relevant MEWP categories, but it does not remove the client's responsibility for site safety, equipment condition, task planning, supervision, or legal compliance.

Clients must not require operators to use equipment or perform tasks outside their certification, competence, legal limits, or safety requirements.

9. User Conduct

All users agree not to:

  • Provide false, misleading, incomplete, or outdated information
  • Misrepresent certifications, qualifications, insurance, rates, availability, or job requirements
  • Use the platform for unlawful, unsafe, fraudulent, or abusive purposes
  • Circumvent IPAF Operator UK after an introduction, booking, or assignment has been arranged
  • Harass, threaten, abuse, discriminate against, or mistreat other users, staff, clients, or operators
  • Interfere with the website, platform, payment systems, or booking process
  • Upload malicious code or attempt unauthorised access to our systems

We may suspend or terminate accounts, cancel bookings, refuse service, or take legal action where these terms are breached.

10. Circumvention

Where IPAF Operator UK introduces an operator to a client, the client must not bypass IPAF Operator UK to engage that operator directly for the same or similar work without our written consent.

This restriction may apply for a reasonable period after the introduction or assignment.

Where a client circumvents the platform, we reserve the right to charge an introduction fee, recover lost fees, suspend the client account, or take further action where legally permitted.

11. Insurance

Operators may be required to hold appropriate insurance depending on the nature of the assignment.

Clients remain responsible for ensuring they hold appropriate site, public liability, employer's liability, equipment, and project insurance.

IPAF Operator UK does not provide insurance cover for client sites, equipment, or project operations unless expressly agreed in writing.

12. Limitation of Liability

Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to the above, IPAFOperatorUK Ltd shall not be liable for:

  • Site accidents caused by unsafe site conditions, defective equipment, or inadequate client supervision
  • Losses caused by inaccurate or incomplete job information supplied by the client
  • Losses caused by an operator acting outside their certification, competence, or instructions
  • Loss of profit, revenue, business, contract, goodwill, or opportunity
  • Indirect, consequential, or special losses
  • Delays, cancellations, or failures caused by events outside our reasonable control

Our total liability to any client or operator shall not exceed the fees paid to us by that user in the 12 months before the event giving rise to the claim.

13. Platform Availability

We aim to keep the website and platform available, but we do not guarantee uninterrupted or error-free access. We may update, suspend, restrict, or withdraw parts of the platform at any time for maintenance, security, operational, or business reasons.

14. Intellectual Property

All website content, branding, logos, text, graphics, software, layouts, and materials are owned by IPAFOperatorUK Ltd or our licensors. Users may not copy, reproduce, distribute, modify, scrape, or create derivative works from our platform or materials without written permission.

15. Account Suspension and Termination

We may suspend or terminate access to our platform or services where a user:

  • Breaches these terms
  • Provides false or misleading information
  • Fails to pay fees or invoices
  • Acts unlawfully, unsafely, abusively, or fraudulently
  • Damages our reputation or commercial interests
  • Creates risk for clients, operators, or the public

Users may request account closure by contacting us. Certain records may be retained after account closure for legal, accounting, compliance, dispute, or insurance purposes.

16. Changes to These Terms

We may update these Terms & Conditions from time to time. Where changes are material, we may notify registered users by email or by placing a notice on our website or platform. Continued use of our services after changes means you accept the updated terms.

17. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
